1. The "LE MUTAGIM" website (hereinafter: "the Website" and/or "the Business") is an online sales website in the field of fashion.

2. The use of masculine language is for convenience purposes only and refers to both genders.

3. The terms and conditions of use of the website, along with the privacy policy and "cookies" policy (hereinafter: "the Terms of Use"), form the basis for any use of the website and exclusively regulate the legal relationship between the Business and the user of the site.

4. The Business reserves the right to change the terms of use of the site from time to time at its sole discretion without the need for prior notice and/or notification. Please carefully read the terms of use and stay updated with them.

5. The website is offered to the public "As Is," and although the Business strives to ensure that the content displayed on the site is complete and accurate, inaccuracies and/or errors may appear in it. The Business is not responsible and shall not be liable for any damages arising from or in connection with that.

6. The Business and/or its representatives shall not be liable and shall not be responsible and shall not bear any direct, indirect, consequential, or special damage, and/or loss and/or financial deficit caused to the user and/or any third party as a result of using or making a purchase through the site, including not in accordance with these terms of use.

7. The records of the Business, including electronic records, regarding the actions taken on the website, including details entered by the user, shall constitute conclusive evidence of the actions' accuracy.

8. A user of the site who places product orders agrees to provide us with his email address, shipping address for the order, and other contact details truthfully and accurately. The user confirms that we may use this information to contact him regarding his order if necessary.

9. We collect and process only the data required to enable us to provide our customers with our services, such as name, delivery address, payment details, mobile phone number, and email address.

10. The user and/or the buyer and/or the customer on the website agree that they shall be personally responsible for their use of this website and for all communication and activities on this website and related thereto. If it is determined that the user of the site is active or engaged in forbidden activity, disrespects other users, there is reasonable suspicion of fraud against the Business, and/or violates the terms and conditions, the Business may temporarily or permanently prevent their access to this website.

11. The prices of the products displayed for sale on the website include VAT, if applicable.

12. The user of the site hereby consents to the Business to contact him in the future and offer him promotions, benefits, and discounts on the website or through any other means of communication, including phone, email, or text messages, subject to obtaining legal consents. The Business is entitled at any time to stop these promotions, benefits, and discounts, replace them, or modify them, subject to applicable laws.

13. The user of the site declares that he is over 18 years old. Entering parent or guardian credit card details shall be deemed consent for the purchase by a minor.

14. The user declares that he is not a disabled person as defined in the Equal Rights for Persons with Disabilities Law, 1998, and is not included in the definitions of an elder, a senior citizen, under the Consumer Protection Law, 1981 as amended, sec 14 g1 (a). In the event that the user is included in any of the above definitions, he must inform the website management in advance and before purchasing services so that the relevant conditions suitable for him can be adapted and explained to him in his language and understanding.

15. The user declares that he is mentally healthy, does not need mental health medications, is not appointed a guardian for the body, and/or does not receive any mental treatment of any kind. If the user cannot declare this, he must inform the Business in advance and before contact, to examine the possibility of contacting him and/or the appropriate method of contact for him.

 

About the Site

1. Approximately 1,500 products are displayed on the site offered for sale by Chinese manufacturers to the buyers, as the site is only an intermediary. Among the products displayed on the site are, among other things, bags, shoes, and fashion accessories (hereinafter: "the Product" and/or "the Products" as appropriate).

2. The site allows customers to make convenient purchases in Hebrew and English, easy and secure purchase of products through the internet network.

3. The site and/or anyone on its behalf are not the manufacturer's agents and are not importers. The ordered delivery will be sent, after quality control, to the customer's home.

4. A customer interested in ordering and purchasing products through the website will select the desired products, choose their size, and click the "ADD" button under each item. The shopping cart can be viewed by clicking on the shopping cart link at the top of the page.

5. The business endeavors to ensure that the product images displayed on the website accurately reflect the products. However, it is clarified that the product images shown for sale on the website are for illustration purposes only, and there may be differences between the products as they appear in the image on the website and the actual products. Additionally, the colors of the products displayed on the website depend on the user's screen display, and the business cannot guarantee that the user's screen display will accurately reflect the actual color of the product.

6. The website provides useful size guides, and on each product page, the product's measurements in centimeters or inches can be viewed. The responsibility for the measurements, sizes, and colors of the ordered products lies solely with the customer. If the shipment is not received or if a different product is sent, the website will be responsible and may compensate, exchange, or cancel the order at its discretion. However, once the order is delivered as placed, no claims against the website or its representatives will be valid.

7. The purchase through the website is subject to the terms specified in this agreement.

8. The use of the website and the execution of any purchase through the website are subject to the customer's agreement to the terms of this agreement and the terms of the website. If the customer does not accept the terms of the agreement, in whole or in part, they are requested to immediately desist from the purchasing process and not enter payment details.

9. The agreement constitutes a binding contract between the customer and the website and/or its representatives.
    

Payment

The purchase on the website can be made in 3 ways, according to the customer's choice:

1. Credit card payment, except for Diners Club and American Express, in up to 6 equal interest-free installments.

2. Using PayPal without installment options.

3. Using Bit without installment options.

4. Before the purchase is approved, the business will verify the customer's details with their card issuer. 

5. The delivery time of the order begins from the moment the order is dispatched.

6. Orders on the website are secure from theft and accidental damage during delivery. Once the customer's purchases are delivered to the address specified at the time of the order, they are no longer covered by insurance.

7. The business reserves the right to discontinue marketing and selling the product at any time, and also to exclude the right to purchase on the website based on its discretion.

Cancellation of an Order

​

1. The products on the website are refurbished items crafted to order. It should be noted that these are not shelf products, but after an order is entered, the customer's request for work is transferred.

2. It is possible to cancel the transaction from the day of purchase until the end of 3 non-holiday days, as this period is the duration of administrative processing of the order before it is transferred to work. The customer declares that they are aware that after 3 days from the date of the order, they will not be able to cancel the order.

3. Cancellation fees (if the order is canceled within the allotted time) are 5% of the product price or 100 NIS, whichever is lower.

4. Refunds will be made at the time of cancellation of the transaction, if possible, or as soon as possible, not later than 7 business days.

5. There are no cancellation fees in the event of a transaction cancellation due to a product defect or non-delivery to the customer, subject to the return of the defective product. In the case of transaction cancellation, returns, and product returns will be at the customer's expense, and it is their responsibility to ensure the shipment of the products according to the business's instructions.

6. For shoe orders, the business allows size exchanges only. There are no returns and/or exchanges for delivered products. The website is not a store and does not hold product inventory. The order placed on the website is the responsibility of the customer. As long as the product is delivered in good condition (i.e., without defects), there is no option to return or exchange it.

7. The business reserves the right to discontinue its operations on the website at any time, and/or to cancel a customer's purchase transaction and/or not approve a customer's order in the event of a problem with the product and/or supply of the product. In this case, the business will refund the full amount paid at the time of purchase.

8. In the event that the business is unable to fulfill the order as committed or at all, it may refund the customer the full amount paid.

Delivery and Product Shipment

1. ​The delivery time of the order begins from the moment the order is dispatched.

2. The business will ensure that the product is shipped to the customer according to the details provided by him at the time of the order. The customer is responsible for ensuring that the provided address is accurate and complete.

3. The delivery of the product to the customer at the address provided by the customer at the time of purchase on the website will occur within 25 business days (business days do not include Fridays, Saturdays, Sundays, eve of holidays, and holidays).

4. A delay in the delivery of the product of up to 15 business days does not constitute a breach of this agreement and will not entitle the customer to any compensation.

5. After the order is dispatched, the customer will receive an email with the tracking details of the order and will be able to track its progress.

6. If the Israeli customs authorities randomly select a package for inspection and request payment for it, the business is not responsible for this payment.

7. The business will not be responsible for any delay and/or non-delivery caused by force majeure and/or events beyond its control.

8. The product price does not include the cost of shipping.

Warranty and Service

​

1. The product warranty covers significant defects in the product's body and/or non-delivery only, and therefore is provided solely by the website.  

2. The business shall not be liable for any direct or consequential damage resulting from the use or misuse of the product, including any incidental, special, indirect, or consequential damages, to the extent permitted by law. The customer assumes responsibility and all risks and liabilities for any loss, damage, or injury to their body and/or property and/or that of third parties resulting from the use or non-use of the product, except in cases where it is determined that the aforementioned damage was caused due to the exclusive negligence of the business.

Data Security and Privacy

1. The business is committed to protecting and respecting the privacy of the user and/or the purchaser and/or the customer on the website.

2. According to the Data Protection Act, the data controller is responsible for ensuring that the customer's data is kept securely, that accurate information about the use of his data is provided to the customer, and that his rights regarding his data are respected.

3. When using the website, information about the customer is collected, such as: name, contact information, email address, phone number, etc., as well as non-personal information, such as: device type, operating system, browser type, and more. The website collects and processes only the personal data necessary to enable it to provide its services, complete and send the customer's purchase.

4. The data collected will be stored in the business's information database.

5. The website will use the collected information in accordance with the provisions of this policy or in accordance with any law, including for the following purposes:
   To enable a personalized user experience.
   To improve the website or service.
   To handle disputes.
   To address technical issues.
   To send newsletters, including periodic advertising.
   Marketing activities or improving our products.
   Any other action permitted to the company by law.
   The user and/or the purchaser on the website hereby give the website permission to keep his details in the website's database for the purpose of sending marketing offers for the website and/or others. Also, the user and/or the purchaser hereby authorize the website to trade in the information and transfer it to the entity that acquired the information from the website, provided that such entity acts in accordance with the law.

6. The legal basis for each of the ways in which the website uses personal data is as follows: (a) Most of the data collected by the website from the customer is necessary to enable the business to fulfill its contract with the customer or to communicate with the customer regarding the contract. The customer provides billing address and email address when purchasing an item from the website so that the business can process their payment and send them their order confirmation. (b) The website also has a legitimate interest in using personal data to ensure that the website's content is presented to the customer and their device in the most effective manner, or to ensure that marketing communication is relevant to the customer's interests. (c) The business may share data with other specialized organizations to detect fraud, reduce credit risks, and maintain financial data for the long term in order to comply with its legal obligations.

7. The business takes reasonable precautions to preserve the confidentiality of information to the extent possible. These precautions reduce the risks of unauthorized intrusion, but they do not provide absolute security. Therefore, the business does not guarantee that its services will be completely immune from unauthorized access to the information stored in them, such as cases that are beyond the control of the business and/or result from force majeure. The business shall not be liable for any direct or consequential damage of any kind caused to the customer if this information is lost and/or used without authorization.

8. The business undertakes not to use the information provided to it by the buyers except to enable purchases on the website and in accordance with the law.

9. The business will retain the customer's personal data for a limited period of time according to the reason for processing his personal data, as follows:
   • When the customer purchases goods from the website, the business will retain the payment data until the end of the relevant accounting period, usually seven years from the date of the charge.
   • Upon payment, the business will retain the customer's payment details until payment confirmation and completion of the relevant accounting and administrative formalities regarding the customer's withdrawal rights and the conditions applicable to the payment dispute.
   • When the business uses the customer's personal data and browsing history to analyze his behavior in order to personalize the website and show him personalized sales offers, the business will retain the data for analytical purposes until the customer requests their deletion.
   • When the business uses personal data for market research and customer satisfaction surveys, it will retain the data until the customer requests us to stop.
   • When a customer contacts the business's customer service team, the business will retain any additional personal information provided by the specific customer for his inquiry as long as he remains an active customer of the website.
   • When a customer contacts the business's customer service team, the business will keep a recording of the call for up to six months for each phone call, and notes will be kept for service and sales purposes.

10. In order to achieve the specified goals in the privacy and cookies policy, the business must provide access to the customer's personal information to third parties who provide support for the services the business offers, namely:
    • Financial institutions.
    • Entities involved in detecting and preventing fraud.
    • Technological and analytical service providers.
    • Partners and service providers in the field of logistics, transportation, and delivery, and/or their partners.

Law and Jurisdiction
